Naga City Council passes anti red-tagging ordinance in final reading

The Sangguniang Panlungsod of Naga City passed the Anti-Red-Tagging Ordinance during its 114th Regular Session on November 13, on its third and final reading to protect free speech by criminalizing unjust labeling.

The ordinance authored by Hon. Jess Albeaus, aims to safeguard Nagueños’ right to free speech, or groups as communists, terrorists, or subversives without valid evidence.
The ordinance explicitly prohibits the use of public funds or resources in carrying out red-tagging activities, ensuring accountability among public officials.
This act, often used to silence political dissent, has led to harassment, intimidation, and threats to personal safety.
Reports of red-tagging incidents targeting community leaders and progressive organizations in Naga and Camarines Sur highlighted the urgency of this ordinance.
Councilor Albeaus acknowledged the contributions of Councilor Atty. Oying Rosales, chair of the Committee on Laws and Ordinances, and Vice Mayor Cecilia Veluz De Asis, whose leadership was instrumental in the ordinance’s passage.
Hon. Albeaus also expressed gratitude to the Naga City Human Rights Action Center, which has been tasked with assisting in processing complaints related to red-tagging.
He also acknowledged Former City Youth Councilor Angella Averilla for her pivotal role in initially proposing the measure in 2021.
This ordinance is the first of its kind in the Philippines, positioning Naga City as a leader in human rights advocacy.

Violators of the ordinance face penalties, including fines of up to ₱5,000, imprisonment of up to six months, or both, depending on the frequency of offenses.
The ordinance will take effect immediately upon publication, reinforcing Naga City’s commitment to uphold human rights and promote a safe environment for free expression and activism.
This development has been celebrated by progressive groups, including Bayan-Camarines Sur, as a milestone victory for grassroots advocacy and the protection of civil liberties.
